The 2018 Landmark Ruling

In Common Cause v. Union of India (9 March 2018), the Supreme Court recognised the right to die with dignity under Article 21, legalising Advance Medical Directives and permitting passive euthanasia — the withdrawal of life support when there is no reasonable hope of recovery.

The 2023 Simplified Procedure

On 24 January 2023, the Supreme Court simplified the original procedure. The Judicial Magistrate countersignature requirement was removed. A directive now requires your signature, two independent witnesses, and attestation by a notary or gazetted officer — making the process accessible to any Indian family.

Important Distinction

A Living Will covers healthcare decisions only — not property or assets. It is completely separate from a property will under the Indian Succession Act. Both documents serve different purposes, and you may need both.
